Consumer Protection Code 2012

We have noticed in Property Claims Direct in the last few months that there have been delays in issuing cheques by insurance companies.

The Consumer Protection Code 2012 states the following:
‘Where a claimant has agreed to accept the offer made by the regulated entity (insurance company), the regulated entity must discharge the claim within 10 business days from the date the claimant has agreed to accept the offer.’

Insurance companies use Loss Adjusters to handle their property claims. They wont issue a cheque without a report from their Loss Adjuster. During extremely busy times eg. the Dublin floods – October 2011, the admin staff of adjsuting companies can be inundated with report requests from Loss Adjusters, leading to delays. Even during normal times the payment can be delayed beyond the allowed 10 days. Using a solicitor in a property damage claim

Its becoming more common to engage a solicitor on a property damage claim where an insurer has declined the claim. Solicitors are useful in interpreting policies to the claimants advantage and can be knowledgeable on case law in similar cases. In Property Claims Direct we only recommend solicitors who specialise in insurance law. Its important to agree fees with a solicitor before engagement as not all solicitors guarantee they can achieve legal fees in the claim. We had a recent case from a clients own solicitor where a fee scale was produced AFTER the claim was settled. We felt this was very unfair on our client.
In Property Claims Direct our fees are very simple – 10% plus vat of the settlement on a ‘no win no fee’ basis (ie – no payout no fee). If we recommend a solicitor we ensure reasonable fees are agreed in advance.

As you can see from the photo we have a partially fire-damaged roof. As an engineer I can design a new roof structure to current standards and under the Public Authenticity Clause in the policy we can claim for all of the sarking felt because the felt in this house is outdated. We were able to claim for all the roof tiles because we proved to the insurance company that it was more cost effective than to try and clean the scorch marks off. Our quantity surveyors did the cost comaprison. Because we employ a range of professionals we are able to cover all issues on any property damage claim.
